چکیده:
زمینه و هدف: عملیات دریافت و پرداخت، بخش عمدهای از فعالیتهای بانکی را تشکیل میدهند. بانکها به طور روزمره با اشخاص و مشتریان مختلف درگیر هستند. تنوع شیوههای پرداخت و کثرت انجام آن در طول شبانهروز گاه موجب اشتباه در پرداخت و دارا شدن ناروای پول توسط شخص ثالث میشود. این مقاله انواع اشتباه در پرداخت و شیوه جبران آن را مورد بحث قرار داده است.
مواد و روشها: روش تحقیق در این نوشتار، توصیفی-تحلیلی است.
ملاحظات اخلاقی: ملاحظات اخلاقی مربوط به نگارش متون و نیز ارجاعدهی به منابع رعایت گردید.
یافتهها: در جریان پرداختهای بانکی و بین بانکی در مواردی ممکن است، به جهت خطای نیروی انسانی یا اختلال در سیستمهای رایانهای پرداخت پول به ناروا صورت گیرد. در صورتی که بانک مسبب این پرداخت اشتباه باشد، رویه عملی بانکها در چنین مواردی بدین گونه است که اگر دریافتکننده وجه ناروا نزد خود بانک، حساب و موجودی داشته باشد، بانک به استناد قراردادی که به هنگام افتتاح حساب با مشتری خود منعقده نموده و یکی از مواد قرارداد منعقده این بوده که چنانچه وجهی به اشتباه به حساب وی واریز شود بانک میتواند رأساً وجه واریزی اشتباهی را مسترد نماید، وجه واریز شده را از حساب وی برداشت مینماید.
نتیجهگیری: پرداخت، اغلب با هدف ایفای تعهد انجام میگیرد. این تعهد ممکن است ناشی از قرارداد یا هر سبب تعهدآور دیگر باشد. در مفهوم عام، فرقی میان ایفای تعهد از طریق بانک یا غیر آن نیست فلذا تمامی پرداختهای اشتباه قابل بازگشت است.
Background and Aim: Receiving and payment of money constitute a major part of banking activities. Banks are involved with different individuals and customers every day. The variety of payment methods and the plurality of it may cause a mistake in payment to a third party. This article discusses the types of mistakes in payment and its restitution practices.
Materials and Methods: The research method in this paper is descriptive-analytical.
Ethical Considerations: Ethical considerations regarding the writing of texts as well as references to sources were observed.
Findings: In the course of bank and interbank payments, in some cases, due to human resource errors or disruption of computer systems, payment may be made inappropriately. If the bank is responsible for this wrong payment, the practical procedure of the banks in such cases is that if the recipient has an account in the bank, the bank, based on the contract he signed with his client at the time of opening the account and one of the articles of the contract, can withdraw the money from his account.
Conclusion: Payment is often done to fulfill the obligation. This obligation may result from binding contract or any other cause. There is no difference in payment between banks and others. If a person makes an undue payment, it could be refunded.
