چکیده:
مسائل مربوط به فقه و جامعه و سياست ، همواره مورد توجه جهان اسلام و انديشمندان سياسي مسلمان بوده است . «فقه »
دانشي است که با جامعه تعامل دارد و لذا پاسخ گوي نيازهاي آن است . با توجه به همين امر است که از آن به فقه الدولۀ، فقه
السياسۀ، فقه الإمارة و فقه الحکومۀ نيز تعبير ميکنند. فقه حکومتي، عبارت از شاخه اي از دانش فقه است که به مسائل مرتبط
با حکومت و ساحت هاي مختلف آن ميپردازد. اين شاخه زيرمجموعه ي فقه سياسي قرار دارد. هدف ما در اين تحقيق بررسي
مقايسه اي ميزان اثرگذاري فقه سياسي شيعه بر قوانين اساسي مشروطه و جمهوري اسلامي است . روش مورد استفاده توصيفي
- تحليلي ميباشد. طبيعي است با عنايت به اينکه بخشي از توسعه فقه سياسي جهت تبديل به فقه حداکثري و تغيير رويکرد
به حکومت محور، در گرو زيست بوم سياسي و حکومتي بوده و سطح انتظار متفاوت از فقه در آن جامعه در گونه قرائت از فقه
سياسي موثر است و از سوي ديگر، بخشي از آن ، در گرو نوع نگرش و روش شناسي متمايز و متناسب با حجم مسائل و
اقتضائات بحث از مسائل سياسي (به عنوان مسائل زمان مند و تابع شرايط و موقعيت ) است ، لذا به همان نسبت که در فضاي
زيست بوم تقيه ، رويکرد فقه سياسي حداقلي، امري مطلوب و متناسب با زمانه به نظر ميرسد در زمان حاکميت سياسي مبتني
بر فقه بر جامعه ، ميبايست فقه سياسي رويکرد حداکثري يافته و به سوي فقه حکومتي متحول شوند وگرنه به عدم درک
مقتضيات زمانه و استنباط غير روزآمد متهم شده و کارآيي خود را از دست خواهد داد.
Issues related to jurisprudence, society, and politics have always been of interest to the Islamic world
and Muslim political thinkers. "Jurisprudence" is the knowledge that interacts with society and
therefore meets its needs. Political jurisprudence, the jurisprudence of the Emirate and the
jurisprudence of the government are also interpreted. Governmental jurisprudence is a branch of
jurisprudential knowledge that deals with issues related to government and its various fields. This
branch is a subset of political jurisprudence. Our most important goal in this study is to compare the
impact of Shiite political jurisprudence on the constitutions of the Constitution and the Islamic
Republic. In fact, this is our main goal in this research. The method used is descriptive-analytical. In a
favorable society, religion is not separate from politics. Religion is a set of laws of life and a
comprehensive program that covers all aspects of human life, especially social issues; Religion is to
break the chains of human captivity and ensure human freedom; Religion is to save the oppressed
from the clutches of oppressors and to end their rule. Obviously, these great goals are not possible
without the formation of society, and this is why it is said that religion and politics are two inseparable
elements; Because if religion is separated from politics, it loses its executive arm completely, and if
politics is separated from religion, it becomes a destructive element in the path of society's prosperity
