چکیده:
زمینه و هدف: یکی از عناصر لازم برای تحقق جرم عنصر معنوی است یعنی فعل و انفعالات ذهنی مرتکب که دارای اجزائی از قبیل علم به حکم و موضوع؛ سوء نیت عام و سوء نیت خاص؛ و انگیزه است. انگیزه که گاهی از آن به داعی، باعث و غرض تعبیر میشود عبارت است از عوامل درونی مانند حسد، عشق، انتقام، لذت طلبی، شهرت طلبی، عدالت خواهی و... که هدف نهایی از ارتکاب جرم است و مرتکب را به سوی ارتکاب جرم سوق میدهد. در واقع میتوان گفت انگیزه عامل حرکت و انجام کار است. روش: این تحقیق با روش توصیفی تحلیلی و با استفاده از منابع کتابخانهای میکوشد تا آموزههای کیفری در رابطه با انگیزه در تحقق جرم مسئولیت کیفری و مجازاتها را از منظر مکاتب گوناگون بررسی کند. یافتهها و نتایج: در این پژوهش ضمن اشارهای به عنصر معنوی و ارکان آن بهطور ویژه به انگیزه میپردازد در پایان با بررسی و تکیه بر نظرات علمای حقوق جزا تبیین میشود که انگیزه در تحقق جرم هیچ تاثیری ندارد و رابطه میان انگیزه سوء و سوء نیت خاص را میتوان رابطه عموم و خصوص مطلق دانست. با این توضیح که هرگاه انگیزه مجرمانه خاصی را قانونگذار جزء ارکان جرم قرار داده باشد، سوء نیت خاص تلقی میشود.
