چکیده:
حیل ربا در معاملات از منظر فقه امامیه با رویکردی بر نظرات امام خمینی (ره) زمینه و هدف: با حاکم شدن فضای پستمدرنیزم بر روابط مردم و پیچیده شدن روابط مزبور، راهکارهای مختلفی برای فرار از مقررات ابداع شده است. یکی از این مقررات، ممنوعیت ربا میباشد. هدف از پژوهش حاضر بررسی راهکارهای فرار از ربا در اندیشه امام خمینی (ره) میباشد. مواد و روشها: این تحقیق از نوع نظری بوده روش تحقیق به صورت توصیفی تحلیلی میباشد و روش جمعآوری اطلاعات بصورت کتابخانهای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. یافتهها: حرمت ربا از مسلمات فقه در همه مذاهب اسلامی است و به وسیله عقل، کتاب، سنّت، و اجماع، حرمت آن قابل اثبات است. حتی در ادیان قبل از اسلام نیز ربا مورد تحریم قرار گرفته است. نزول تدریجی آن دلالت بر شیوع معاملات ربوی در صدر اسلام دارد. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. نتیجهگیری: ملاک حرمت ربا از دیدگاه قرآن، ظلم و انظلام است. در نتیجه، حرمت آن مطلق و راهکارهای فرار از آن نیز حرام میباشند؛ به تعبیری، صرف ایجاد کردن یک پوشش برای فرار از ظاهر ربا، موجب مباح شدن عمل نخواهد شد.
Background and Aim: With the prevalence of postmodernism on people-to-people relationships and the complexity of these relationships, various strategies have been devised to evade regulation. One of these regulations is the prohibition of usury. The purpose of this study is to investigate strategies to escape from usury in the thought of Imam Khomeini.Materials and Methods: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles.Ethical considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.Results: The sanctity of usury is one of the tenets of jurisprudence in all Islamic religions and its sanctity can be proved by reason, Qur’an, tradition, and consensus. Even in pre-Islamic religions, usury has been banned. Its gradual decline indicates the prevalence of usurious transactions in the early days of Islam.Conclusion: According to the Qur'an, the criterion for the sanctity of usury is oppression and injustice. As a result, its absolute sanctity and ways to escape from it are also forbidden; In other words, simply creating a cover to escape the appearance of usury will not make the action permissible
