چکیده:
تصویب لایحه قانونی کار از نظر مبانی فقهی با اشکالات جدی شورای نگهبان مواجه بود. این لایحه الزاماتی از جمله ساعت کار، میزان مزد و بیمه کارگر را بر کارفرما تحمیل میکرد و شورای نگهبان، از آنجا که قرارداد کار را بر اساس احکام اجاره اشخاص در فقه تحلیل مینمود، اشکال این لایحه را از این جهت میدانست که این الزامات هیچ وجه شرعی ندارد. در نگاه فقهای شورای نگهبان رابطه کارگر و کارفرما، یک رابطه کاملاً خصوصی است که دولت حق ورود و دخالت در آن را ندارد. اصرار مجلس شورای اسلامی از سویی و انکار شورای نگهبان از سوی دیگر، نهایتاً به تأسیس مجمع تشخیص مصلحت نظام منتهی شد که دست آخر با قید مصلحت به تصویب لایحه قانونی کار مبادرت ورزید. با وجود این، مشکلات فقهی این قانون به عنوان معمایی حلنشده باقی ماند. در این نوشتار با یک تحلیل کاملاً فقهی سعی در واکاوی مبانی فقهی قرارداد کار شده و مبنای ورود حکومت به این قرارداد، عدم نفوذ قراردادهایی بیان شده که در وضعیت سوءاستفاده از اضطرار منعقد میشود که به نوبه خود موضوع مداخله حکومت در قرارداد کار را محقق میسازد.
The passage of the Labor Bill was fundamentally flawed by the Guardian Council. The bill imposed requirements such as working hours, wages, and workers' insurance on the employer. The Guardian Council, since analyzing the employment contract by the provisions on the lease of persons in jurisprudence, blamed the bill for this.These requirements were not religious in any way, according to the council. In the view of the jurists of the Guardian Council, the labor-employer relationship is a completely private one in which the government has no right to enter or interfere. The insistence of the Islamic Consultative Assembly, on the one hand, and the denial of the Guardian Council, on the other, eventually led to the establishment of the Expediency Council, which eventually approved the bill on expediency. However, the jurisprudential problems of this law remain a mystery. With this article, an attempt has been made to analyze the jurisprudential aspects of the employment contract. Finally the basis of the government's intervention into this contract is the lack of influence of contracts concluded in the event of an emergency breach.
