چکیده:
یکی از مفاهیم کلیدی که در توسعه حقوق بینالملل نقش مهم داشته است، مفهوم تعهدات عامالشمول بوده است. این تعهدات از آن جهت که از ارزشهای بنیادین جامعه بینالمللی حمایت میکنند، از سایر تعهدات حقوق بینالملل متمایز بوده و برخلاف تعهدات دوجانبه و متقابل حقوق بینالملل، به تمامی دولتها تعلق داشته و براین اساس تمامی دولتها در رعایت آنها دارای منفعت حقوقی هستند. علیرغم اینکه درباره مفهوم تعهدات عامالشمول به عنوان بخشی از بدنه حقوق بینالملل، کمتر تردید شده است، ضوابط شناسایی و محتوای آن همواره محل بحث بوده است؛ از این رو، چیستی این تعهدات و ارائه راهکاری دقیق برای شناسایی آن یکی از مسائل مناقشهبرانگیز و دشوار حقوق بینالملل به شمار میآید. این مقاله در پی پاسخگویی به این سؤال است که «با توسل به چه رویکردهایی میتوان تعهدات عامالشمول را در پهنه حقوق بینالملل مورد شناسایی قرار داد؟». روش بررسی این پژوهش، تحلیلی-توصیفی میباشد و شیوه گردآوری اطلاعات، کتابخانهای است. با هدف زدودن ابهامات در خصوص چگونگی شناسایی تعهدات عامالشمول، دو رویکرد «ساختارگرایی» و «اهمیّتگرایی» به عنوان رویکردهای پیشنهادی در این راستا مورد واکاوی قرار خواهند گرفت. یافتههای این پژوهش نشان میدهد رویکرد «اهمیّتگرایی» با ارائه دو راهکار، نخست شناسایی تعهدات عامالشمول بواسطه قواعدآمره حقوق بینالملل و دوم، شناسایی تعهدات عامالشمول از طریق قواعد عرفی حقوق بینالملل (تعهدات عامالشمول غیرآمره)، برای این منظور مناسبتر است.

This article seeks to find answer to the following question: "What approaches can be applied to identify Erga Omnes obligations in the realm of international law?" The research explores two approaches to identifying Erga Omnes obligations in the realm of international law; first, according to the structural approach, non-bilateral obligations, the violation of which does not harm any particular stats, is considered Erga Omnes. Second, according to the material approach to identifying Erga Omnes obligations, an obligation will be considered an Erga Omnes when it has a material element, which is protecting the fundamental values of the international community. This approach can be find in the proceedings of the International Court of Justice. In material approach, Erga Omnes obligations can be identified through either Jus Cogens norms or dispositive norms (customary Erga Omnes obligations) of international law
