چکیده:
علاقه ذاتی و غریزی آدمیان به مالکیت بر دستاوردها و آنچه که احتیاجات آنها را در زمینههای مختلف برطرف میسازد باعث شده است تا انسانها از دیرباز اصل مالکیت را به رسمیت بشناسند. ادیان آسمانی، از جمله شریعت اسلام به عنوان آخرین دین الهی نیز محترم بودن مالکیت خصوصی را امضا و تأیید کرده است. اسلام نه تنها مردم را بر اموالشان مسلط دانسته و به آنها اختیار تصرفات گوناگون در ملکشان را داده، بلکه دخالت دیگران در ملک اشخاص را جز با رضایت کامل آنها ممنوع ساخته است، با این حال از آنجا که دستگاه حاکم متولی اداره امور جامعه و مسئول انجام خدمات عمومی و اجرای عدالت در جامعه و زمینه ساز اعمال مالکیت اشخاص می باشد. این اصل با محدودیت هایی مواجه شده و موجب شده که مالک به دستگاه حاکم در مواردی اجازه سلب مالکیت را راستای اعمال مصالح اجتماعی بدهد. محدودیتهایی که بر مالکیّت خصوصی افراد از سوی دستگاه های حاکم اعمال می شود، در چارچوب دو معیار «مصلحت و ضرورت» قابل بررسی است. بر این اساس پژوهش حاضر به دنبال بررسی نقش مصلحت و ضرورت در ترجیح مالکیت نوعی اجتماعی بر مالکیت شخصی میباشد. نتایج پژوهش حاکی از آن است که ضرورت حفظ نظم و نظام اجتماعی و در افقی برتر برقراری عدالت اجتماعی ایجاب می کند

Accordingly, the present study seeks to investigate the role of expediency and necessity in the preference of a kind of social ownership over personal property. The results of the study indicate that the need to maintain social order and in the highest horizon of social justice requires that the rule of society,
