چکیده:
برخی در اصول فقه، وصف را دارای مفهوم دانسته، ولی مشهور آن را فاقد مفهوم میدانند و با توجه به قابلیت تطبیق بحث در حقوق موضوعه، بررسی مفهوم داشتن وصف برای حقوقدانان نیز دارای اهمیت بسیاری خواهد بود. گاه برای اثبات مفهوم، ادعا میشود که باید بین وصف و حکم مقرر در منطوق، ملازمه از نوع سببیت انحصاری وجود داشته باشد، اما به نظر، صِرفِ وجود ملازمة قطعی بین وصف و حکم منطوق کفایت میکند و با عنایت به مقصود گوینده، برداشتِ مخاطب و مفسّر، ظهور عرفی و تبادر، بنای عقلا، حکیم بودنِ قانونگذار، اصل تعیین قاعدة کلی در قوانین، استقراء و کثرت استعمال میتوان بر وجود مفهوم مخالف برای اکثرِ اوصاف، لااقل در حقوق موضوعه اظهار نظر نمود. در این تحقیق همچنین نشان داده میشود که وصف در یک تقسیمبندی به احترازی که واجد مفهوم بوده و توضیحی و غالبی که فاقد مفهوم هستند، تقسیم میشود و همچنین گاه، قیدِ حکم است که دارای مفهوم بوده و گاه، قیدِ موضوع است که فاقد مفهوم میباشد. در نهایت نشان داده میشود که «وصف، در قوانین دارای مفهوم مخالف است مگر اثبات شود، توضیحی، غالبی یا قیدِ موضوع است یا ملازمهای با حکم منطوق، ندارد
In Principles of Islamic Jurisprudence, some believe that the description has a concept but the majority consider it does not have a concept, and due to the ability to adapt the discussion in the substantive law, the study of having a concept for description is also important for lawyers. It seems that only the existence of a definite connection between the description and the decree is sufficient, and considering the speaker's meanings, the perception of the respondent and the interpreter, the emergence of the custom, the rationale of the intellects, the wisdom of the legislator, the principle of determining the general rule in the law, the induction and the plurality of use, it is possible to comment on the existence of a contrary concept for the description, at least in substantive law. Also, the description is divided into avoidance and explanatory. Also, sometimes, it is a decree matter that has a concept, and sometimes a subject matter that does not have a concept. Finally, it is shown that "the description, in the laws, has the contrary concept, unless it is proved to be an explanatory, dominant, or subject matter, or is not associated with the decree rule
