چکیده:
زمینه و هدف: سیاست جنایی دیوان عالی کشور در جرائم علیه امنیت، به دلایل مختلف با چالشهای اساسی مواجه است. مهمترین چالشهای سیاست جنایی دیوان عالی کشور در جرائم علیه امنیت عبارتاند از: عدم توجه به یافتههای علمی در رشتههای مختلف برای دستیابی به اصول و نظریات مستند و مستدل، امنیت مداری بر پایهی گفتمان حفظ محوری که بعد از 40 سال از تشکیل حکومت اسلامی همچنان جایگزینی ندارد.
روش: پژوهش حاضر به روش توصیفی و تحلیلی انجامشده است.
یافتهها و نتایج: تأثیرپذیری افراطی از عوامگرایی کیفری با توجه به گسترش ارتباطات و رسانههای اجتماعی در فرآیند رسیدگی، صدور حکم و اجرا، میل به راضی نگهداشتن افکار بینالمللی و جهانی و سازمانها و نهادهای بینالمللی باوجود قوانین و مقرراتی که بهشدت موردانتقاد این مراجع هستند، عدم پویایی و عدم هماهنگی بین سیاست قضائی دیوان و سیاست تقنینی در جرائم علیه امنیت و برخی دیگر از چالشهای فنی در فرآیند دادرسی مانند تعیین صلاحیتها، نقض اصول دادرسی منصفانه بهعنوان یک راهکار اصلی و اثربخش که بتواند دیوان عالی کشور را در مسیر مناسب اتخاذ یک سیاست جنایی کارآمد و عدالت محور قرار دهد. ازاینرو میتوان گفت که بهرهگیری از تجربیات کشورهای دیگر در برخورد با این جرائم و تعامل بیشتر دیوان با نهادهای امنیتی مانند شورای عالی امنیت ملی، کمیسیون امنیت ملی مجلس و وزارت اطلاعات میتواند در رفع چالشها مؤثر باشد.

Finding and Conclusion: The extreme effectiveness of criminal populism due to the expansion of communication and social media in the process of investigation, sentencing and execution, the desire to satisfy international and global opinion and international organizations and institutions. Despite the laws and regulations that are strongly criticized by these authorities, the lack of dynamism and lack of coordination between the court's judicial policy and legislative policy in crimes against security and some other technical challenges in the judicial process, such as determining qualifications, violations The principles of fair trial as a main and effective solution that can put the Supreme Court on the right path to adopt an efficient and justice-oriented criminal policy.Therefore, it can be said that taking advantage of the experiences of other countries in dealing with these crimes and greater interaction of the court with security institutions such as the Supreme National Security Council, the National Security Commission of the Parliament and the Ministry of Information can be effective in solving the challenges.
