چکیده:
هدف: در جوامع انسانی و به منظور تنظیم و قاعده مند نمودن روابط میان آحاد جامعه بر اساس هنجارهای حاکم و مورد قبول آن جمع، بایدها و نبایدهایی وضع میگردد. گاهی این بایدها و نبایدها از چنان درجه از اهمیتی برخوردار هستند که جامعه، فرد نقض کننده آن را تنبیه و مجازات مینماید. در راستای این اصل و مفهوم بدیهی در روابط انسانی، دین مبین اسلام و به طور خاص مذهب تشیع؛ در مقام داعیه دار و ارائه دهنده نظریه جامع و کامل در تنظیم روابط انسان از ما قبل از تولد تا بعد از فوت، جهت ترسیم مدینه فاضله اسلامی و در راستای رسیدن به کمال و تعالی هر فرد دارای برنامه میباشد. مواد و روشها: این مطالعه توصیفی- تحلیلی میباشد که با استفاده از منابع فقه شیعه، اطلاعات آن جمع آوری و تحلیل گردید. یافتهها: اسلام با برنامههای تربیتی و اخلاقی و عبادت و خودسازی، از سویی و اصلاح محیط سازنده، از سویی دیگر، موجبات جرم و گناه را از بین میبرد و از وقوع جنایات، پیشگیری میکند. به این معنی که اکثر افراد در جامعه اسلامی یا از تربیت والای اسلام برخوردارند، و یا دست کم، تحت تاثیر محیط سالم قرار دارند، در عین حال باز هم عدهای خواهند بود که آزادانه اصلاح پذیر نیستند، و میخواهند از هر فرصتی سوءاستفاده کنند، و دست به خیانت و تجاوز به حقوق دیگران بزنند، اسلام برای قطع این علفهای هرزه جامعه، گذشته از مجازات و عقاب شدید اخروی، در همین دنیا، قوانین کیفری مقرر داشته، تا این عده، از بیم کیفر و مجازات، مرتکب جرائم و جنایات و خلاف قانون نشوند و در جامعه تجاوزها، ریشه کن و نظم و آرامش برقرار باشد. نتیجهگیری: به طور کلی میتوان بیان داشت مجازاتهای شرعیه در مرحله تشریع، اثبات و اجرا با استفاده از روشهای تربیتی توبه و عبرت آموزی، انذار، تبشیر، اعطای بینش، مواجهه با نتایج اعمال، تغافل تادیب، نقش صیانت از امنیت و حیات جامعه، و پیشگیری از بزه و دفع فساد و تادیب مجرمان بالقوه و بالفعل را ایفا میکنند.

Results: The results showed that Regardless of the topic of ethics, which is guaranteed to be implemented in the afterlife, in Shia jurisprudence books, the rules governing human relations are stated under the four topics of worship, transactions, iqaaat and rulings. The punishments prescribed by the Holy Law in the framework of hadd, ta'zir, diya and qisas play an important role in human education. Although Islamic punishments are explained in detail in jurisprudence books with a jurisprudential and ijtihad perspective, their educational goals have been neglected.
Conclusion: In general, it can be said that there are instructive moral and educational points among the Shari'a orders and laws related to the proof of the crime and the characteristics of the criminal and the quality of their execution and punishment, which can be a model for individuals and society, Islamic punishments should also be considered with this approach.
