چکیده:
زمینه و هدف: بررسی چگونگی تاثیر اجرای تعهدات قرارداد بر توسعه اقتصادی از منظر نهاد گرایان میباشد. از این منظر پس از بسط فضای مفهومی موضوع به بررسی ابعاد و جنبههای مختلف تاثیر اجرای تعهدات قرارداد بر توسعه اقتصادی پرداخته شده است. مواد و روشها: این تحقیق از نوع نظری بوده روش تحقیق به صورت توصیفی تحلیلی میباشد و روش جمع آوری اطلاعات به صورت کتابخانه ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافتهها: از منظر نونهادگرایان، قواعد حقوق به طور عام و قواعد حقوق قراردادها به طور خاص میبایست کارآمد بوده و در نتیجه به حداکثرسازی ثروت در جامعه منتج شوند و به تبع آن شرایط برای توسعه اقتصادی فراهم آورند. نتیجه: از نظر نهادگرایان نظامهای حقوقی و اقتصادی با یکدیگر ارتباط ارگانیک دارند؛ به گونه ای که هر دوی آنها در واقع جزئی از نظام اجتماعی به حساب میآیند، که از آن با عنوان تئوری «توازن دوگانه» نام برده میشود نهادگرایان بر خلاف رویکرد بازار به کارآمدی حقوق قراردادها در توسعه ی اقتصادی باورمند بوده و بر هم کنشی میان کارآمدی حقوق قراردادها و توسعه اقتصادی به عنوان نقطه ثقل نهادهای حقوقی و اقتصادی تاکید دارند.
Background and Aim: This article aims to investigate how the implementation of contract obligations affects economic development from the perspective of institutionalists. From this point of view, after expanding the conceptual space of the subject, we will examine the different dimensions and aspects of the impact of the implementation of contract obligations on economic development.Materials and Methods: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles.Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.Results: From an economic point of view, the rules of law in general and the rules of contract law in particular should be efficient and as a result lead to the maximization of wealth in the society and accordingly provide conditions for economic development. Among other things, this matter has been taken into consideration by the neo-institutionalist school in economics.Conclusion: First, according to institutionalists, legal and economic systems are organically related to each other; In such a way that both of them are actually part of the social system, which is called the "double balance" theory. Secondly; Unlike the market approach, institutionalists believe in the effectiveness of contract rights in economic development and emphasize the interaction between the effectiveness of contract rights and economic development as the center of gravity of legal and economic institutions.
