چکیده:
بیع، از کهنترین و رایجترین عقود در جوامع بشری است. این عقد پر اهمیت، مورد امضای شارع در شریعت مقدس اسلام قرار گرفته و با توجه به ماهیت عرفی آن فقیهان تعاریفی از عقد بیع ارائه نمودهاند. با تأمل در اغلب این تعاریف استنباط میشود که مبیع باید «عین» باشد، درحالیکه امروزه اموالی که وجود خارجی ندارند مانند ارزهای دیجیتال و انواع مختلف حقوق ازجمله حق تألیف، سرقفلی و... به کثرت در عرف، مورد خریدوفروش واقع میشوند. با تدقیق در دیدگاه فقیهان، مشخص میشود که در رابطه با الزام عین بودن مبیع، بین فقها اختلافنظر وجود دارد و برخی از آنان، بیع را «انتقال ملک» و بعضی دیگر «انتقال عین» تعریف کردهاند. اختلافنظر در این زمینه در نظرات حقوقدانان هم قابلمشاهده است. در کتاب و سنت نیز مطلبی در رابطه با ضرورت عین بودن مبیع مطرح نگردیده و همچنین برای این موضوع نصی در منابع فقهی یافت نشده و فقهای متقدم نیز بر مبنای فتاوی سایر فقها به این شرط تصریح کردهاند. اگر چه در سال 1307 تعریف عقد بیع، تعریفی سازگار با جامعه و عرف تلقی میشده است، اما در دوره زمانی کنونی ادله طرفداران عینیت مبیع مورد قبول نبوده و محل انتقاد هستند و باید قید «عین» از تعاریف مذکور حذف و تعبیری مناسب با واقعیت عرفی ارائه گردد که به اعتقاد نگارندگان این تعبیر، «مال» اعم از عین خارجی، حق، منفعت و... است. این پژوهش با روش توصیفی، تحلیلی و بر پایه منابع کتابخانهای انجامشده است
The contract of sale is one of the oldest and most common contracts in societies.This important contract has been signed by the holy legislator in the sacred Shari'ah of Islam and due to its customary nature, the jurists have provided definitions of the contract of sale.Carefully on most of the definitions are understood to mean that the object of sale must be the concrete object, whereas nowadays properties that non-external existence. they are traded in abundance.Examining the viewpoints of the jurists, it is clear that there is disagreement among the jurists regarding the obligation of the object of sale to be objective, and some of them have defined the sale as "transfer of property" and others as "transfer of object".There is also disagreement in this regard in the opinions of lawyers. In the book and tradition, there is no mention of the necessity of the object being the seller. Also, no text has been found for this issue in jurisprudential sources, and earlier jurists have specified this condition based on the fatwas of other jurists. Although in 1307 the definition of a contract of sale was considered a definition compatible with society and custom, but in the current period the arguments of the proponents of objectivity are unacceptable and subject to criticism and that the term "object" should be removed from the definitions and appropriate interpretation of customary reality be provided that according to the authors of this interpretation, it is property, including concrete object, right, benefit, and so on.
