چکیده:
با افزایش تکثرگرایی حقوقی در نظام بینالمللی معاصر تداخل حوزههای سرمایهگذاری و حقوق بشر افزایش یافته است. از اینرو توازن این دو حوزه امری ضروری است و این امر چیزی نیست جز تشویق سرمایهگذاری و ایجاد توازن در فضای سرمایهگذاری مبتنی بر معیار حقوق بشر که با گذر زمان این امر خود را در رویه قضایی داوری سرمایهگذاری نشان داده است. در این مقاله سعی شده براساس تحلیل آرا موجود در این زمینه، ضمن شناسایی محدودیتها، الگوهای رایج استنادپذیری حقوق بشر در داوری سرمایهگذاری را مورد مداقه قرار دهیم. از اینرو به نظر میرسد رویه قضایی موجود مبهم، نارسا، متناقض و نوپاست. از اینرو باید نیمۀ پر لیوان مبتنی بر جسارت طرح و استناد به حقوق بشر را نگریست و این مسئله قابل انکار نیست که هنوز در بسیار از مواردی، محاکم ذاتاً میل به داوری یکطرفه و متعصبانه به نفع معاهده سرمایهگذاری دارد. البته محاکم در این رابطه واهمۀ خروج از صلاحیت و سوء استفاده دولتهای میزبان را دارند و در این راستا نقش استنادپذیری حقوق بشر مبتنی بر اصول اساسی حقوق بینالملل و چارچوب معاهده سرمایهگذاری برای تفسیر بسیار کلیدی است. ضرورت اقدام حقوق بشری و نبودن چارهای دیگر باید در دیوان اثبات شود تا داوران بتوانند نقض تعهدات را مبتنی بر آن اقدام توجیه کنند. تغییر رویه محاکم در راستای امکان ورود جوامع بومی و سازمانهای مردمنهاد به عنوان اشخاص ثالث کمک شایانی به استنادپذیری حقوق بشر مینماید. در نهایت کشوری که محل اجرای حکم است، میتواند با استناد به نظم عمومی آرا سرمایهگذاری که خلاف حقوق بشر است را اجرا نکند؛ هرچند این مسئله در عمل با چالشهایی روبهرو است.

Is. In this article, it is tried based on the analysis of opinions in this field while identifying the limitations; Let's examine the common models of human rights citation in investment arbitration. Therefore, it seems that the existing legal procedure is vague, insufficient, contradictory and new. Therefore, it is necessary to look at the half-full glass based on the boldness of the proposal and the reference to human rights, and it cannot be denied that in many cases, the courts have an inherent desire for one-sided and biased arbitration in favor of the investment treaty. Of course, in this regard, the courts are afraid of leaving the jurisdiction and abuse of the host governments, and in this regard, the role of the citation of human rights based on the basic principles of international law and the framework of the investment treaty is very key for interpretation. The necessity of human rights action and The lack of other options must be proven in the court so that the judges can justify the violation of obligations based on that action.
