چکیده:
با توسعه و تحول جوامع، پدیده ی مجرمانه نیزدچارتحول شده است.تحولاتی که می توان نحوه ی اجرای مجازاتهای قانونی را به سمت و سوی مصلحت اندیشی حاصل از مقتضیات جوامع و تحولات آن سوق دهد. این مقاله درصددپاسخ به این پرسش برآمده است که آیامصلحت اندیشی درمجازات مرتکبین فعل مخل نظم اقتصادی باعدالت دراجرای قانونی درتعارضند؟رابطه ی فی مابین آن ها درفقه وحقوق چگونه است؟که نگارندگان تحقیق با روش تحلیلی توصیفی وکتابخانه ای به بررسی واژه ی مصلحت اندیشی درفقه وحقوق تحت مجازات ها بخصوص جرایم مخل نظم اقتصادی بدین نتیجه رسیده اند که مصلحت اندیشی درواقع نه برای گروه خاصی بلکه برای عموم مردم می باشد.بنابراین دین اسلام که برپایه ی عدل وعدالت بنا نهاده شده است باتبعیضات حاصل ازمصلحت در اجرای مجازات هادر تعارض است.همچنین اینکه در فقه اسلام جرایم اقتصادی از مصادیق بارز فعل حرام تلقی می گردند و تمام آثار نامطلوب فردی، اجتماعی، تربیتی و حتی روحی را در خود جمع کرده اند. به همین منظور با نگاه به سوابق جرایم اقتصادی در اسلام متوجه می شویم که با این گونه جرایم سخت برخورد شده است و تبعیض حاصل از مصلحت اندیشی با جرم انگاری های صورت گرفته و مجازات ها در جرایم اقتصادی در فقه و حقوق در تعارض است.
With the development and transformation of societies, the criminal phenomenon has also changed. This article seeks to answer the question of whether expediency in the punishments of perpetrators of acts disturbing the economic order is in conflict with justice in law enforcement. What is the relationship between them in jurisprudence and law? Under punishments, especially crimes that disrupt the economic order, they have come to the conclusion that expediency is not really for a specific group but for the general public. In Islamic jurisprudence, economic crimes are considered as obvious examples of haram acts and have gathered all the undesirable personal, social, educational and even spiritual effects. For this reason, looking at the history of economic crimes in Islam, we find that such crimes have been dealt with severely, and the discrimination resulting from expediency is in conflict with the criminalizations and punishments in economic crimes in jurisprudence and law.
