چکیده:
در معاملات، افراد به دادن یا ستاندن وثیقه برای اطمینان خاطر از رسیدن به حق خود استفاده می کنند که یکی از این اسباب، عقد ضمان است و تقریبا در تمامی جوامع از آن استفاده می شود.هر دو نظام حقوقی اسلامی و کامن لا به بررسی این نهاد حقوقی پرداخته و با توجه به مبانی حقوقی خود به تعیین آثار پرداخته اند. در فقه و حقوق ایران، اقتضای اطلاق عقد ضمان، ناقل بودن ذمه است که در طی آن ذمه مضمون عنه بری و ذمه به ضامن در مقابل مضمون له مشغول می شود و در سایر مذاهب اسلامی، ضم ذمه بودن اثر اطلاق عقد ضمان می باشد که در این صورت با انعقاد عقد، ذمه مضمون عنه بری نشده بلکه ذمه ضامن نیز در کنار مضمون عنه در مقابل مضمون له برای طلب وی، مشغول می شود.در این عقد می توان قائل به سه نوع از روابط شد و احکام را با توجه به اثری که از عقد حاصل می شود بررسی کرد،یکی روابطی که ما بین ضامن و مضمون له ایجاد می شود و دیگری روابطی که بین ضامن و مضمون عنه به وجود می آید و در آخر هم روابطی که ما بین مضمون له و مضمون عنه امکان برقراری آن هست.در نظام حقوقی کامن لا، اثر عقد ضمان ضم ذمه به ذمه می باشد ولی در بعضی از مسائل ناشی از این عقد، مانند مرور زمان در مورد عقد ضمان اتحاد نظر و رویه واحدی نسبت به این عقد وجود ندارد
